Terms of Service
Effective June 12, 2026
These Terms of Service (“Terms”) govern your access to and use of the Roamer platform, including our website, traveler app, and hotel partner portal (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.
1. About Roamer
Roamer is a private travel marketplace. We connect flexible travelers with luxury hotel and resort partners across Mexico and Canada. Travelers submit stay requests; hotel partners respond with perk-bundled offers. Roamer curates the top offers and facilitates the booking — we are not a party to the underlying accommodation contract between traveler and hotel.
2. Eligibility
You must be at least 18 years of age to use the Service. By using Roamer, you represent that you meet this requirement and that the information you provide is accurate.
3. Accounts
- You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
- You may not share your account with others or use another person's account without permission.
- Notify us immediately at hello@useroamer.com if you suspect unauthorized access to your account.
4. Traveler terms
Stay requests
When you submit a stay request, you are expressing genuine intent to book a qualifying stay. Roamer routes your request to hotel partners who respond with private, perk-bundled offers. You are under no obligation to accept any offer.
Offers and acceptance
Offers are provided by hotel partners and are valid for the time period stated on each offer card. Once an offer expires it cannot be accepted. Accepting an offer constitutes your agreement to the terms, pricing, and perks described in that offer.
Deposits and payment
A deposit may be required at the time of offer acceptance to secure your booking. The deposit amount and any payment processing terms will be clearly presented before you confirm. Payment is processed securely; Roamer does not store your full card details.
Cancellations
Cancellation policies are set by the hotel partner and communicated in your booking detail. To initiate a cancellation, use the cancellation form in your booking or contact our concierge team. Refund eligibility depends on the applicable policy and is not guaranteed.
5. Partner terms
Applications and approval
Hotel partners must apply and be approved by Roamer before accessing the partner portal. Roamer may decline or revoke partner status at its discretion, including for inactivity, policy violations, or failure to maintain offer quality.
Offers and fulfillment
Partners are responsible for honoring all accepted offers, including the perks, pricing, and dates stated. Failure to fulfill a confirmed booking without reasonable cause may result in suspension or removal from the platform.
Commissions and fees
Commission rates and billing terms are communicated separately during the partner onboarding process. By submitting an offer and having it accepted, you agree to pay the applicable commission on the booking value.
No public discounting
Roamer is a private channel. Partners must not publish or advertise the same perk bundles or package pricing offered through Roamer on public booking platforms.
6. Prohibited conduct
You agree not to:
- Submit false, misleading, or speculative stay requests.
- Attempt to circumvent Roamer to book directly with a partner after receiving an offer through the platform.
- Use the Service for any unlawful purpose.
- Attempt to access accounts, systems, or data that do not belong to you.
- Reverse-engineer, scrape, or interfere with the Service.
7. Intellectual property
All content, branding, and software comprising the Service are owned by Roamer or its licensors. You may not copy, modify, or distribute any part of the Service without our written permission.
8. Disclaimers
The Service is provided “as is.” Roamer does not guarantee that the Service will be uninterrupted or error-free, that offers will be available for any specific destination or date, or that any particular request will result in offers.
Roamer is a marketplace facilitator. We are not responsible for the quality, safety, or accuracy of hotel accommodations, amenities, or perks provided by hotel partners.
9. Limitation of liability
To the maximum extent permitted by law, Roamer's total liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid to Roamer in the 12 months preceding the claim, or (b) $100 CAD. Roamer is not liable for indirect, consequential, or punitive damages.
10. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
11. Changes to these Terms
We may update these Terms from time to time. We will notify registered users of material changes by email and update the effective date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
